ACQUISITION AND SALE Our firm assists our clients in all areas of acquisition and sales from negotiating and finalizing the initial land purchase agreement to preparing an agreement for the purchase or sale of a residential home.
Examples of our area of practice are as follows: - Acquisition of 80 acres of commercial property located on a prime development corner in Omaha. - Representation for the sale of nine gas stations to a national company. - Representation of a developer acquiring 450 farm acres and a corresponding farm lease agreement with the seller farmer. - Representation of a local developer for all acquisitions and sales of commerical property.
SANITARY AND IMPROVEMENT DISTRICTS In Nebraska, the law permits developers to install a development infrastructure including paving, utilities and sewers through public financing. Our firm is responsible for the formation and administration of a Sanitary and Improvement District and for the construction of these public improvements by the SID. We also assist the developer in obtaining SID underwriter financing for these projects.
LEASING The real estate leasing practice of Brown & Wolff provides responsive, prompt solutions to clients' needs drawing upon the talents of lawyers skilled in negotiating and drafting leases. Our clients are owners, tenants and management companies, in project development, lease negotiations, property management and lease enforcement for retail, office and mixed use properties. EMINENT DOMAIN Brown & Wolff regularly represents private landowners and government entities in eminent domain and inverse condemnation proceedings. The firm regularly challenges valuation issues for all types of properties.
Examples of Eminent Domain work in which we have been involved include: - Representation of a client for the taking of highway right of way by the State of Nebraska resulting in an award of approximately $775,000 to our client. - Representation of a sanitary and improvement district against a private property owner for the condemnation of property to be utilized for the installation of public improvements resulting in a nominal damage award to the private party owner.
CONSTRUCTION Our firm represents numerous clients who are general contractors, subcontractors and architects requiring negotiation and preparation of contracts for their various projects.
DEVELOPMENT Our firm has a very extensive development practice. During the last 20 years, we have represented developers of over 40 million square feet of residential, retail, office and mixed use projects. Our clients appreciate our commitment to keep a project moving by assisting in the acquisition of a parcel of property, forming and representing the Sanitary and Improvement District, preparing contracts for the various service providers (architects, engineers, contractors), working with planning and other municipal officers in zoning and subdivision platting, environmental compliance, management contractors and sale or lease agreements and advice on all legal aspects of development.

- Lincoln Place - a 180 acre mixed use development located on 216th and Lincoln Road in Gretna, containing 364 residential lots, 7.1 acres of multi family and 6.8 acres of commercial property.
